1. Agreement and Eligibility

By accessing or using SafeRx ("the Service"), you agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding legal agreement between you and SafeRx.

Eligibility Requirements:

• You must have the legal capacity to enter into binding contracts
• If you do not agree to these Terms, you must immediately stop using the Service

Your continued use of SafeRx after any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

SafeRx provides prescription digitization and drug information services including:

• Prescription image processing and text recognition (OCR)
• Drug interaction checking
• Side effects information lookup
• Pregnancy and lactation safety information
• Drug alternatives suggestions

All information is provided for educational and reference purposes only.

3. Medical Disclaimer and No Professional Relationship

Drug information may be incomplete, outdated, or contain errors. You acknowledge that medication effects vary by individual and that only a qualified healthcare provider can assess your specific medical situation.

4. User Responsibilities

When using SafeRx, you agree to:

• Provide accurate information when using our services
• NOT rely solely on SafeRx for any medical or medication decisions
• Verify all drug information with qualified healthcare providers
• NOT use the Service for any illegal purposes
• NOT attempt to circumvent, disable, or interfere with security measures
• NOT upload malicious, harmful, or inappropriate content
• NOT use automated systems to access the Service without permission
• Comply with all applicable laws and regulations

5. Proprietary Database and Data Protection

• Data Scraping: Using automated tools, scripts, bots, crawlers, or any software to systematically extract, download, copy, or harvest data from SafeRx
• Database Enumeration: Systematically querying our services to compile, reconstruct, or replicate our drug databases, interaction databases, or any proprietary data collections
• Bulk Data Extraction: Making excessive requests designed to extract large portions of our database, whether automated or manual
• API Abuse: Using our interfaces in ways not intended for normal individual use, including but not limited to automated querying or data harvesting
• Reverse Engineering: Attempting to reverse engineer, decompile, or extract our database structures, algorithms, or data mappings
• Commercial Exploitation: Using extracted data to create competing products, services, or databases
• Data Resale: Selling, licensing, or distributing any data obtained from SafeRx to third parties

Legal Consequences: Violations of this section may result in:

• Immediate termination of service and permanent ban
• Civil liability for damages, including the full commercial value of the data extracted
• Injunctive relief and recovery of attorney's fees
• Criminal prosecution where applicable under computer fraud and data protection laws

Our drug databases, interaction databases, mapping data, and algorithms represent proprietary assets with significant commercial value. Any unauthorized extraction or use may result in claims for damages based on this value, which may amount to substantial sums.

6. Accuracy and Limitations

While we strive for accuracy, you acknowledge and agree that SafeRx:

• Does NOT guarantee 100% accuracy of prescription text recognition
• May NOT include all possible drug interactions, side effects, or contraindications
• Uses databases that may have limitations, gaps, or outdated information
• Should NEVER replace professional pharmaceutical verification
• Makes no warranties about the completeness or reliability of information

7. Limitation of Liability and Indemnification

Indemnification: You agree to indemnify, defend, and hold harmless SafeRx and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

8. Your Data Rights

Your use of SafeRx is governed by our Privacy Policy. You have the following rights:

• Right to Access: Request information about what data we have about you
• Right to Deletion: Request deletion of your personal data at any time
• Right to Opt-Out: Disable push notifications and optional features

9. Intellectual Property

All content, features, functionality, trademarks, and intellectual property of SafeRx are owned by SafeRx and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

10. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SafeRx operates.

Informal Resolution: Before filing any formal dispute, you agree to first contact us at info@saferx.online to attempt informal resolution. We will work in good faith to resolve any issues within 30 days.

Limitation Period: Any claim or cause of action arising from your use of SafeRx must be filed within one (1) year after the claim arose, or be permanently barred.

11. General Provisions

• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SafeRx
• Waiver: Failure to enforce any right or provision shall not constitute a waiver of that right
• Assignment: You may not assign your rights under these Terms. SafeRx may assign its rights without restriction
• Modifications: We may modify these Terms at any time. Material changes will be posted with an updated "Last Updated" date. Continued use after changes constitutes acceptance
